Corruption and Corporate Criminal Liability

This paper explores the basis and extent of corporate criminal liability for “true crimes,” with a particular emphasis on corporate liability for corruption offences. This paper attempts to answer when a corporation will be held liable for mens rea offences committed by its employees, while also examining the basis upon which such liability is attached to a corporation. Topics not covered in this paper include: enforcement, procedural and evidentiary issues, sanctions and alternatives, and issues relating to strict liability and absolute liability offences.
