The Proposed International Criminal Court

This paper is about the efforts to create a supra-national mechanism for bringing individuals to justice for gross violations of international humanitarian law, and, in particular, about the Draft Statute for an International Criminal Court (ICC) prepared by the International Law Commission (ILC) during its 1994 session and since discussed widely. This paper supports the International Law Commission’s flexible approach to the jurisdiction of the Court as the best model achievable at present.
